Carl Schmitt (1888–1985) was a legal theorist, political philosopher, and the author of Legality and Legitimacy, On the Three Types of Juristic Thought, Political Romanticism, Nomos of the Earth, Roman Catholicism and Political Form, Crisis of Parliamentary Democracy, and The Concept of the Political, the last available from the University of Chicago Press. Schmitt begins On the Concept of the Political with a single sentence, “The concept of the state presupposes the concept of the political.” This is where he breaks with Hobbes and Weber. Rather than view the violence of the state as an antidote to the violence of humanity, Schmitt views it as a tool to extend conflict. In this, his most influential work, legal theorist and political philosopher Carl Schmitt argues that liberalism’s basis in individual rights cannot provide a reasonable justification for sacrificing oneself for the state—a critique as cogent today as when it first appeared.

However, says Schmitt, ‘the notion of state presupposes a concept of the political’. For politics is not merely a consequence of the state. Its existence, in fact, precedes the latter’s. Since man leads a social life, every society is necessarily characterised by political organisation.

[6] Schmitt's argument that political concepts are secularized theological concepts has also recently been seen as consequential for those interested in contemporary political theology. The German-Jewish philosopher Jacob Taubes , for example, engaged Schmitt widely in his study of Saint Paul , The Political Theology of Paul (Stanford Univ. Press, 2004).
